Stop humiliation and the violation of privacy of the citizens
The signatory organizations, are known to the public authorities, human rights organizations, associations, media and public opinion, the following statement:
Today, Article 230 of the Criminal Code is once again wreaking havoc, this time condemning a young man of 22 years.
Stopped since September 6, 2015, the young man was interrogated attempt on his private life and his sexual orientation and a violation of his correspondence by reading personal messages (sms) on his cell phone;
He must also undergo an anal test to “prove his homosexuality”, which constitutes an act of torture according to the United Nations committee against torture; and the signatory associations consider an act of rape;
Tunisia is a signatory to the Universal Declaration of Human Rights, the Covenants on Human Rights and the Convention against torture, these practices are a violation of human rights and the rights guaranteed by the Tunisian constitution .
We recall in this context articles 21, 23 and 24 of the constitution:
“Article 21: Citizens shall have equal rights and duties. They are equal before the law without discrimination. The State guarantees citizens the freedoms and individual and collective rights. It ensures that they ensure conditions for a dignified life.
Article 23: The State protects the dignity of the human being and physical integrity and prohibits physical or moral torture. The crime of torture is imprescriptible.
Article 24: The State protects privacy, inviolability of the home and the confidentiality of correspondence, communications and personal data … ”
We strongly condemn these facts and demand the immediate release of the man in question.
We also demand the repeal of Article 230 of the Tunisian Penal Code as a provision unconstitutional and inconsistent with provisions of international conventions duly ratified by Tunisia.
